As relações entre direito do trabalho, legislação trabalhista e inspeção do trabalho são complexas e somente sua análisepode explicar a constituição e a razão de ser da inspeção do trabalho. O direito do trabalho surge com a ampliação da divisão social do trabalho e criação das relações de trabalho da sociedadecapitalista, proporcionando não somente um material específico para atuação do direito, como envolvendo este nesse processo de expansão da especialização na sociedade moderna. A legislação trabalhista é oconjunto de leis que buscam regularizar as relações de trabalho e tem sua origem na luta operária pela diminuição do processo de exploração. A inspeção do trabalho tem como pré-condição a existência da legislação trabalhista e do direito do trabalho. A instituição da inspeção do trabalho é produto da luta de classes, bem como os elementos que são sua pré-condição, o direito do trabalho e a legislação trabalhista.
