Resumo do Surgimento da Previdência Social

RESUMO

O presente estudo tem por objetivo expor um breve resumo do surgimento da Previdência Social, bem como explicar os benefícios concedidos pela autarquia, adentrando em pontos específicos. A Previdência Social é regida por benefícios ofertados ao segurado contribuinte, que após cumprido os requisitos básicos passa a perceber o benefício que lhe faz jus. Um ponto importante a ser destacado no presente esboço constitui em alta médica programada de auxílio-doença.

A alta médica programada estabelece data certa para cessação do benefício por incapacidade, na modalidade de auxílio doença. Alta programada surgiu após o decreto nº 5.844, de 13 de junho de 2006, o regulamento permite à autarquia INSS, determine data certa para cessação de benefício, tal procedimento é adotado sem a realização de nova perícia médica.

O ato de estipular a alta médica programada fere a Constituição Federal, o art. 196 estabelece o direito de todos, dever do Estado, garantido mediante políticas sociais e econômicas, que visem à redução do risco de doença e de outros agravos, regido pelo princípio do acesso universal e igualitário, às ações e serviços para sua proteção e recuperação. No entanto, a fixação da data certa, acaba acarretando um desamparo ao obreiro, que na maioria das vezes se encontra inapto para retornar às atividades habituais, para gozar do benefício de auxílio-doença o segurado é submetido à perícia médica, contudo, para cessação, o requisito perícia médica não é praticado.

A data de cessação de benefício é um ato administrativo realizado por perito médico, que após análise médica emite ao segurado comunicado de decisão, que por sua vez é emitido com alta certa programada/data de cessação do benefício, estabelecendo ao segurado um tempo estimado para que fique em gozo do auxílio doença, podendo ser prorrogado quinze dias antes da cessação do benefício.

O ato de estipular a alta programada viola o artigo 62, da Lei de Benefícios da Previdência Social - Lei 8213/91, de 24 de julho de 1991.

The purpose of the present study is to disseminate a brief publication of the Social Security article, as well as explain the benefits granted by the municipality, going into specific points. The benefit cessation date is an exercise by a clinical expert, who undergoes medical examination in relation to the power of decision-making, which in turn is reported with highly accurate scheduled / cessation benefit data, that stay in enjoyment of the encyclopedia disease, using a period of death.

The act of paying the high law violates article 62 of the Law on Benefits of Social Security - Law 8213/91, of July 24, 1991.
