Resumo Bala Perdida

RESUMO

A responsabilidade civil do Estado na ocasião de bala perdida ainda é um evento muito desconhecido pelo meio acadêmico, porém de muita importância para o nosso cotidiano como futuros operadores de direito, principalmente no que tange as relações estabelecidas pelo Estado e sociedade. Existe uma responsabilização estatal de indenizar, se houver comprovação de que a “bala perdida” foi proveniente da arma de um policial, em tese, o “garantidor” da segurança pública, que em desacordo com a situação, acabado ferindo um terceiro. Diante disso, busca-se com este estudo fazer uma análise geral sobre o instituto responsabilidade civil do Estado pela atuação de agentes públicos no exercício legal do Direito, onde será visto o entendimento de diversos doutrinadores e algumas posições em nossos tribunais, principalmente no que se refere a obrigação de indenizar por parte do Estado.

ABSTRACT

The liability civil of the State on the occasion of a stray bullet is still a lot unknown event by academia, but of great importance to our daily lives as future operators of law, especially regarding the relations established by the state and society. There is a state responsibility to indemnify, if there is evidence that the "stray bullet" came from the gun of a policeman, in theory, the "guarantor" of public safety, we disagree with the situation, just wounding a third. Therefore, we seek to make this study a general analysis about the institute civil liability of the State for the performance of public officials in the lawful exercise of the right, where we will see the understanding of many scholars and some positions in our courts, particularly in refers to the obligation to indemnify the State.
