Terms of Use

General

As part of our service, WindSolutions LTD agrees to provide downloadable evaluation versions of its software. WindSolutions agrees to provide this service free of charge. You agree to use the service in accordance with the Terms of Use. WindSolutions may amend or modify the Terms of Use at any time.

End User License Agreement

This license agreement is a legal agreement between you the end user (as an individual) and WindSolutions. The software and any of its supporting documentation are herein after referred to as the product.

By installing or using the product, you indicate your complete and unconditional acceptance of these terms and conditions.

Should there be any conflict between the terms and conditions of this agreement and the terms and conditions of any other agreement between you and WindSolutions in relation to the product the terms and conditions of this agreement shall apply.

Information contained in the product is subject to change without notice and does not represent a commitment or contracted obligation on the part of WindSolutions.

Evaluation License Agreement

You are granted a non-exclusive right to use the product and its documentation for the evaluation period indicated in the product from the date you install the product, for its intended purposes only. At the end of the evaluation period, you must either purchase the product or remove the product from your computer.

Purchased License Agreement

After purchase, you may use the product on as many computers as you personally own; this typically includes several computers of a small family living under the same roof or your work computer if it is clearly attributed to you. Your purchase gives you the right of using the product for an unlimited period of time and upgrading to newer versions for a period of one year following the date of purchase.

Warranty

All our products are 100% success guaranteed to work on the iPod, iPod Touch, iPhone and related software they were designed for. If in spite of our assistance, one of our products fails to fulfill its purpose, we will refund you within 14 days of your purchase.

Privacy

WindSolutions will not use or disclose to any third party your personal information for any purpose.

Limitations of Liability

Under no circumstances shall WindSolutions be liable for any direct or indirect damage arising from your use of its product.

Disclaimer

License fees for the product do not include any consideration for assumption of risk by WindSolutions and WindSolutions disclaims any and all liability for incidental or consequential damages arising out of the use or operation of or inability to use the product, even if WindSolutions has been advised of the possibility of such damages. Furthermore, you indemnify and agree to hold WindSolutions harmless from such claims.
