O Direito ao Trabalho, Ressocialização, Penitenciárias, Crise no Cumprimento da Pena, População Carcerária.

A presente monografia tem como objetivo analisar a importância do trabalho na execução da pena e no retorno a sociedade pelo egresso, além da importância do trabalho e do estudo como forma de redução da superlotação por meio da remição da pena. Em seguida, trataremos das desigualdades observadas em grande parte das penitenciárias Brasileiras, no quesito população carcerária. Por fim, demonstraremos a problemática existente frente à ressocialização nos presídios Brasileiros por conta da superpopulação carcerária, reincidência criminal e, além disso tudo, ressaltar a importância de trabalhar este tema, por conta do grande impacto positivo para a sociedade que é o cumprimento digno da pena com posterior reintegração social do condenado. Nosso trabalho monográfico utiliza-se do método dedutivo, sendo de natureza qualitativa bibliográfica, uma vez que faz uso de projetos de lei, legislação, conteúdo online e doutrina. Desse modo, foi possível concluir que o trabalho na vida do preso é de grande importância, pois além de sentir-se útil, o reeducando aprende uma profissão que irá ser seu sustento durante a reintegração social. Além disso, também foi observado que a maioria dos privados de liberdade são negros, jovens e pobres de pouca instrução escolar, logo, consequentemente, o investimento na repressão e prevenção criminal deve ser feito nas raízes do crime e não somente depois do crime já cometido.

This monograph aims to analyze the importance of work in the execution of the sentence and in the return to society by the egress, in addition to the importance of work and study as a way of reducing overcrowding through the redemption of the sentence. Next, we will deal with the inequalities observed in most Brazilian penitentiaries, in terms of the prison population. Finally, we will demonstrate the existing problem facing the resocialization in Brazilian prisons due to prison overpopulation, criminal recidivism and, in addition, highlight the importance of working on this topic, due to the great positive impact for society that is the dignified fulfillment of the sentence with subsequent social reintegration of the condemned. Our monographic work uses the deductive method, being of a qualitative bibliographic nature, since it makes use of bills, legislation, online content and doctrine. In this way, it was possible to conclude that the work in the prisoner's life is of great importance, because in addition to feeling useful, the reeducated learns a profession that will be his livelihood during social reintegration. In addition, it was also observed that the majority of those deprived of their liberty are black, young and poor with little schooling, so, consequently, investment in repression and criminal prevention must be made at the roots of the crime and not only after the crime has already been committed.
