The family once considered only parents and children constituted by marriage regulated by the state, has undergone a historical evolution in relation to its constitution. The Federal Constitution of 1988 has come to recognize stable unions between men and women without the civility of traditional marriage, as a family unit, subject to the requirements of the law. But the parallel union to traditional marriage, which is the adulterous liaison, is not regulated in any Brazilian legal system, leaving a gap on the subject, as today there are many cases of simultaneous families seeking a solution to the lived relationships. Given this reality, it becomes the subject of this work, which has the problem whether or not the legal, property and pension rights for concubinage, and if there are, what are those rights. As a general goal, there is the need to present the existing doctrinal positions on the subject, explaining them within the constitutional principles and the jurisprudence of the Brazilian Courts. We highlight the importance of the principles of human dignity and the principle of monogamy, that guide the decisions that seek the production of legal, property and welfare effects for those involved in clandestine relationship. Thus, it becomes necessary to build a study on the evolution of the family and family law within the Brazilian legal system, bringing the existing concepts about the various forms of the family, observing the principles that helped build the legal moral family legally constituted. Also fulfills the observation of the doctrine discussed in relation to the subject, having as theoretical framework the author Maria Berenice Dias, who repudiates adulterous relations, but believes that when it is not known duplicity of relationships, should be taking effect in obligatory context
