PARENTAL ALIENATION IN THE CURRENT BRAZILIAN LEGAL SYSTEM

RESUMO

Este estudo analisa a conduta de alienação parental bem como suas consequências psicológicas, observando a aplicabilidade e efetividade da lei e demais diplomas legais que visam coibir tais atos. O objetivo é fazer uma pesquisa afim de identificar todas as facetas da alienação parental, além de compreender o embate revogação versus manutenção que vem sendo amplamente discutido dentro da comunidade jurídica e da psicologia, para então buscar alternativas para melhor proteção do menor. O estudo foi desenvolvido com base na pesquisa bibliográfica, na análise da legislação, doutrinas, artigos científicos, revistas e blogs jurídicos. Utilizando-se para tal a busca por meio da internet, bem como no acervo literário da Faculdade Católica Dom Orione, com o auxílio do orientador. Conclui-se que a revogação não constitui a melhor medida diante do uso desvirtuado da lei. Devendo o Direito se concentrar na criação de melhorias e capacitação dos profissionais que lidam com ela.

ABSTRACT

This study analyzes the parental alienation conduct as well as its psychological consequences, observing the applicability and effectiveness of the law and other legal diplomas that aim to restrain such acts. The objective is to make a research in order to identify all the facets of parental alienation, besides understanding the clash between revocation versus maintenance that has been widely discussed within the legal community and psychology, to then seek alternatives for a better protection of the child. The study was developed based on bibliographic research, analysis of legislation, doctrine, scientific articles, magazines and legal blogs. For such, it was used the internet search, as well as the Dom Orione Catholic College's literary collection, with the supervisor's help. The conclusion is that revocation is not the best measure when faced with the distorted use of the law. The Law should focus on the creation of improvements and the training of professionals who deal with it.
