RESUMO

O dano moral proveniente da alienação parental é te

ma polêmico e pouco estudado no âmbito

do direito de família. Sobre esse assunto é necessá

rio análise de critérios multidisciplinares,

pois a matéria deve ser vista sob o prisma jurídico

, psicológico, antropológico e social. A

lesão relativa à prática da alienação parental caus

a danos morais identificáveis, por vezes

muito tempo após o processo danoso. O dano moral de

ve ser analisado sob a ótica civil

constitucional como violação ao direito fundamental

da pessoa, levando em consideração a

responsabilidade atribuída aos pais exercentes da a

utoridade parental. A responsabilidade civil

no que tange o direito de família tem como base o d

ano que envolva os partícipes desta

relação, sendo, pois de caráter subjetivo. A metodo

logia aplicada na pesquisa foi de caráter

bibliográfico e documental e tendo o caráter descri

to analítico. Ao final conclui-se pela

possibilidade de identificação do dano moral nas re

lações familiares e principalmente o que

tange ao causado pela alienação parental, Porém se

torna mais difícil coibi-lo, mas não

impossível, pois através de métodos legislativos e

com a ajuda da sociedade, o Poder

Judiciário pode e deve inibir esta prática.

damage that involves the participants of this

relationship, and therefore of the subjective chara

cter. The research methodology was

acter described analytical. At the end we

conclude by identifying the possibility of moral da

mage in family relationships and especially

with respect to that caused by parental alienation,

however becomes more difficult to stop it,

but not impossible, for through legislative methods

and with the help of the society , the

Judiciary can and should inhibit this practice.
