RESUMO

O presente trabalho monográfico versa sobre a (in)efetividade legislativa perante os crimes cibernético, em especial a Pornografia da Vingança. Cabe a este estudo trazer uma análise detalhada da inserção do Estado Democrático de Direito e dos direitos e garantias fundamentais no ordenamento jurídico brasileiro. Partindo da premissa de que o Estado precisa amparar e respeitar os direitos individuais do ser humano, da mesma forma que deve resolver de forma razoável as questões que são de sua responsabilidade, cabendo a ele a criação de tipos penais adequados ao combate de ilícitos praticados no meio ambiente digital. Por fim, tem-se a necessidade de um maior amparo jurídico aos direitos fundamentais, principalmente os que versão sobre o direito à privacidade, para garantir uma maior segurança jurídica no âmbito digital.

ABSTRACT

This monograph deals with the legislative (in)efficacy before the cybercrimes, especially the Porn Revenge. It is up to this study to bring a detailed analysis of the insertion of the Democratic Rule of Law and the fundamental rights and guarantees in the Brazilian Legal System. On the assumption that the State needs to protect and respect the individual rights of the human being, in the same way that it should fairly resolve the issues that are its responsibility, being up to it to create adequate criminal types to combat the crimes practiced in the digital environment. Finally, there is a need for a greater legal protection to fundamental rights, especially those about the right to privacy, to ensure a greater legal certainty in the digital scope.
