RESUMO

No contexto em que vivemos atualmente, o uso da internet vem alterando significativamente as relações sociais. Isso porque, o individuo hoje, possui uma vida virtual paralela à sua vida real, onde o uso indiscriminado da internet, cumulado com a ausência de educação e ética digital trouxeram, junto com a novidade das relações digitais, problemas oriundos destas novas relações, entre elas, o cyberbullying.

Embora não exista idade mínima para se constatar a ocorrência de Bullying virtual, já se tem conhecimento que nos dias de hoje também é comum tal prática entre os adultos, porém aqui, iremos abordar a prática da violência em âmbito da infância e juventude onde, em sede escolar, surgem as primeiras perseguições virtuais e onde deve haver as primeiras intervenções com objetivo de conscientizar e restaurar as relações da vida real, afetadas no cyber espaço pelas relações virtuais.

Assim, é necessário entender o cyberbullying, sua origem e incidência, bem como as prováveis causas de sua ocorrência e suas consequências jurídicas no Brasil, que engatinha no sentido de que, ainda não traz soluções que abrangem o assunto em sua integralidade, considerando as suas peculiaridades e diferenças.

A Justiça restaurativa, longe de ser a panaceia de todos os conflitos oriundos da prática do Cyberbullying, demonstra ser o “pulo do gato” no que concerne o combate à violência virtual no âmbito escolar, haja vista possuir valores e métodos capazes de restaurar vínculos através dos procedimentos restaurativos.
