BRASIL: O PAÍS DO TRANSFEMINICÍDIO

RESUMO: O presente trabalho trata do feminicídio, incluído pela lei 13.104/2015 alterando o artigo 121 do Decreto-Lei nº 2.848, de 7 de dezembro de 1940, o Código Penal, para prever o homicídio contra mulher em razão do sexo feminino como circunstância qualificadora do crime de homicídio e a (im)possibilidade da sua aplicação quando a vítima for uma mulher trans. Deste modo, primeiro analisa-se os conceitos de gênero e transexualidade. Logo depois, o crime de feminicídio e transfeminicídio – nomenclatura utilizada para o feminicídio de pessoas trans - é apresentado, partindo-se do texto legal, e, posteriormente analisando suas interpretações. Esclarecem-se, em seguida, os diversos conceitos jurídicos atuais de mulher e sua possibilidade ou não de figurar o pólo passivo de um feminicídio. Ao fim, problematiza-se a aplicabilidade da lei em favor da vítima trans, analisando a necessidade de alteração da Lei para abrangência do gênero e sua funcionalidade perante a sociedade.

ABSTRACT: This paper deals with femicide, included by law 13.104 / 2015, amending article 121 of Decree Law No. 2848 of December 7, 1940, the Penal Code, to provide for homicide against women on grounds of female gender. qualifying circumstance of murder and (im) possibility of its application when the victim of a trans woman. starting from the legal text and then analyzing its interpretations. Next, we clarify the various current legal concepts of women and their possibility or not of figuring the passive pole of a femicide. Finally, problematize law enforcement in favor of the trans victim by analyzing the need for law change for gender coverage and their visual identity in society.
