RESUMO

A Caraterização de Dolo Eventual e Culpa Consciente nos Acidentes de Trânsito. Trabalho de Conclusão de Curso (Graduação em Direito). União da Vitória, 2013.

O presente trabalho tem por objetivo analisar o dolo eventual e a culpa consciente nos crimes de trânsito. No primeiro momento conceitua-se o Direito Penal, com um breve histórico, em seguida abrangeu-se a teoria do crime, crime e contravenção, a teoria do dolo e a teoria da culpa e outros elementos pertinentes ao estudo. Em seguida, no segundo capítulo, trata-se do dolo eventual e culpa consciente em suas peculiaridades, conceituando suas semelhanças e diferenças, bem como a posição de renomados doutrinadores. No terceiro capítulo tratou-se sobre o trânsito, conceituando-o conforme o Código de Trânsito Brasileiro, bem como o aumento da frota automobilística no Brasil e os problemas que esta evolução acarretou nas cidades e, a legislação vigente. Por fim, no quarto capítulo, foi tratado especificamente do dolo eventual e culpa consciente nos acidentes de trânsito, bem a legislação atual, as jurisprudências e doutrina dominante sobre o tema, demonstrando as divergências e polêmicas que envolvem o assunto.

ABSTRACT

This study aims to analyze the eventual intention and conscious guilt in traffic crimes. At first conceptualized the Criminal Law, with a brief history, then covered up the theory of the crime, felony and misdemeanor, the theory and the theory of intentional fault and other elements relevant to the study. Then, in the second chapter, it is the eventual intention and conscious guilt in their peculiarities, conceptualizing their similarities and differences, as well as the opinion of renowned scholars. In the third chapter was treated on transit, conceptualizing it as the Brazilian Traffic Code, as well as increased automobile fleet in Brazil and the problems that this development resulted in the cities, and the law. Finally, in the fourth chapter, was specifically addressed the eventual intention and conscious guilt in traffic accidents and current legislation, case law and prevailing theory on the subject, demonstrating the disagreements and controversy surrounding the subject.
