Resumo Reunião Familiar Direito

RESUMO

O trabalho tem como objetivo destacar a importância da reunião familiar como princípio do direito internacional garantidor de direitos básicos da família nas políticas migratórias, ponto em debate a sua importância e sua efetivação nas políticas migratórias brasileiras. Foi realizado um estudo sobre o instituto da migração, no que consiste. Apresentado as diferenças com a anterior legislação que abordava o tema e a atual legislação, bem como sua regulamentação em território nacional. Por fim, dispõe sobre a delimitação do conceito de família, principal elemento para fruição do direito debatido. É posto em xeque a real eficácia da implementação deste direito, face a regulamentação responsável pelo direito da reunião familiar.

ABSTRACT

                The purpose of this paper is to highlight the importance of family reunification as a principle of international law that guarantees basic family rights in migratory policies, a point that is under discussion about its importance and its effectiveness in Brazilian migration policies. A study was carried out on the institute of migration, which consists. Presented the differences with the previous legislation that dealt with the subject and the current legislation, as well as its regulation in national territory. Finally, it deals with the delimitation of the concept of family, the main element for the enjoyment of the right under discussion. The real effectiveness of the implementation of this right is questioned, in view of the legislation responsible for family reunification law.
